    1. Acceptance of Terms

    By accessing or using CinemaONE by POSitive Cinema ("Service"), operated by Positive Cinema, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

    2. Description of Service

    CinemaONE is a cinema management software platform provided on a subscription basis. The Service includes ticketing, point of sale, scheduling, analytics, marketing, digital signage, and related tools for cinema operations.

    3. Account Registration

    To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration.

    4. Subscriptions and Payments

    Subscriptions are billed on a monthly or annual basis as selected during signup. All fees are non-refundable except as required by applicable law or as explicitly stated in your service agreement. We reserve the right to modify pricing with 30 days' notice.

    5. Acceptable Use

    You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

    • Use the Service in any way that violates applicable laws or regulations
    • Attempt to gain unauthorized access to any part of the Service
    • Interfere with or disrupt the integrity or performance of the Service
    • Transmit any malicious code or harmful content

    6. Intellectual Property

    All content, features, and functionality of the Service — including software, text, graphics, logos, and trademarks — are owned by Positive Cinema and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.

    7. Data and Privacy

    Your use of the Service is also governed by our Privacy Policy. You retain ownership of any data you input into the Service. We will process your data in accordance with our Privacy Policy and applicable data protection laws.

    8. Limitation of Liability

    To the maximum extent permitted by law, Positive Cinema and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

    9. Indemnification

    You agree to indemnify and hold harmless Positive Cinema from any claims, losses, or damages arising from your use of the Service or violation of these Terms.

    10. Termination

    We may suspend or terminate your access to the Service at any time for violation of these Terms. You may cancel your subscription at any time through your account settings. Upon termination, your right to use the Service ceases immediately.

    11. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Poland.

    12. Changes to Terms

    We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

    13. Severability

    If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
